Courts have traditionally relied on the assumption that a photograph represents reality. That assumption is no longer valid. We are seeing a rise in “the liar’s dividend”—where bad actors can dismiss real evidence as “just a deepfake,” and conversely, fake evidence can be presented as real.

Emerging Standards

To combat this, new standards are emerging. The C2PA (Coalition for Content Provenance and Authenticity) is setting the technical groundwork for digital provenance. Governments are also stepping in; the EU AI Act and various US state laws are beginning to mandate disclosure for AI-generated content.
